Send Technology Corporation (“Send Tech”), the DNUS entity here, and Send Foundation (“Send”) operate the mobile application Pluto Wallet (the “App”), the website https://plutomobile.app and related products and services (collectively, the “Services”)
These Terms of Use (the “Terms”) govern your access to and use of the Services; please read them carefully before proceeding.
By accessing or using the Services or by clicking “Accept,” you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy (incorporated by reference). If you do not agree, you must stop using the Services immediately.
You and Send Tech agree to resolve disputes by individual, binding arbitration under the American Arbitration Association’s rules in Wilmington, Delaware and you waive any right to participate in class or representative actions.
Eligibility: You must be at least 18 years old (or have parental consent) and not barred under any applicable law.
Prohibited Jurisdictions: Pluto Wallet is unavailable to residents of the United States, China, Singapore, Myanmar, Ivory Coast, Cuba, Crimea, Sevastopol, Democratic Republic of Congo, Iran, Iraq, Libya, Mali, Nicaragua, North Korea, Somalia, Sudan, Syria, Yemen, Zimbabwe, or any other region subject to sanctions by the US, UK or EU.
Non-Circumvention: You may not use VPNs or other methods to bypass these restrictions.
Send Tech has deployed smart contracts on the Solana blockchain (the “Protocol”), which you may invoke directly or via our App interface. By using the App, you obtain a fully self-custodial wallet service that lets you create/manage wallets and hold, send, receive, and swap digital assets peer-to-peer.
The App is strictly a visual interface; it does not custody funds, execute trades itself or provide financial advice.
All transactions occur on the Solana network and incur network transaction fees (“Gas Fees”) paid by you. Pluto Wallet charges no additional platform fees beyond Gas Fees, except where disclosed in-app before confirmation. You are responsible for all taxes, duties, and assessments arising from your use of the Services.
All fiat-to-crypto on-ramp, identity verification and related compliance are managed by Privy under its own regulatory licenses. By using these features, you agree to provide accurate information and complete any checks required by Privy. We may suspend or terminate your access or report you to authorities for non compliance.
We reserve the right to disable or restrict your access at any time for breach of these Terms, violation of law, or geographic ineligibility. We will not be liable for any losses resulting from suspension or termination of access.
You may be required to register or authenticate via third-party credentials (e.g., Google, Apple, Twitter, Discord) through Privy. You agree to keep all credentials confidential and to update any information you submit so it remains accurate. All blockchain interactions occur peer-to-peer; Pluto Wallet does not act as custodian or counterparty, nor provide investment advice.
Your use involves significant risks market volatility, smart contract bugs, network congestion, API outages, and third-party downtime. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES, express or implied (including merchantability or fitness for a particular purpose). You assume full responsibility for any losses or damages.
The App relies on external providers for wallet infrastructure (Privy), on-ramp (Privy), swaps (Jupiter Aggregator), embedded-wallet support (Solana AppKit), analytics, oracles, and hosting. We disclaim all liability for outages, errors, or losses arising from these services.
All content, trademarks, logos and software are owned by Send Tech, Send or licensors. You may not reproduce or create derivative works without prior written consent. By submitting feedback, you grant us a perpetual, worldwide, royalty-free license to use and incorporate it.
You agree to indemnify and hold harmless Send Tech, Send and their officers, directors, employees, and agents from any claims, liabilities, losses, or expenses arising from your breach of these Terms or your use of the Services.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SEND TECH, SEND, OR THEIR AFFILIATES BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED USD 100 OR THE AMOUNT YOU PAID IN THE PRIOR TWELVE MONTHS, WHICHEVER IS LESS.
These Terms are governed by the laws of the State of Delaware without regard to conflict-of-law principles. All disputes shall be resolved by binding, individual arbitration under the AAA’s rules in Wilmington, Delaware with a waiver of class actions. Parties may seek small-claims relief in local courts.
We may modify these Terms at any time by updating the “Last Updated” date. Your continued use of the Services after such changes constitutes acceptance.
These Terms and the Privacy Policy constitute the entire agreement. If any provision is invalid, the remainder remains in effect. Provisions intended to survive termination shall do so.
